Provisional terms of use

1. Who we are, what these terms cover

PaSiCC at pasicc.org is run by Bento Software UG (haftungsbeschränkt), Hessestr. 12, 32049 Herford, Germany, registered at the Amtsgericht Bad Oeynhausen under HRB 13124 ("we"). These terms apply to every use of PaSiCC: the website, its app and its interfaces. By registering you accept them. They don't take away any rights the law of your country gives you as a consumer.

These terms are provisional: they apply until final terms replace them. The 2 weeks' notice of section 9 doesn't apply to that switch; PaSiCC offers you the final terms as soon as they are published, and you can then only continue using PaSiCC once you have accepted them.

2. PaSiCC is in public beta

PaSiCC is being tested in public. It works, but it still changes: features are added, changed or removed, and errors can happen. During the beta PaSiCC is free of charge. We aim for PaSiCC to be available and your data to be safe (backups every night, kept in a second place), but during the beta we can't promise either: keep a copy of what matters to you, for example with the export in your profile.

When the beta ends (when paid licenses are offered), we tell you by email at least 2 weeks before. Your beta license then becomes a free license for a limited time; continuing after it needs a paid license under the terms that apply then. Without one, your account is restricted when the free license ends (you can still read and export everything) and deleted 30 days later; we warn you by email before each step.

3. Your account

  1. You need an account; you may register if you are at least 16 years old.
  2. Give an email address you can receive mail at: we send the confirmation, password resets and notices about your account there. An account whose address isn't confirmed within 24 hours is deleted.
  3. Give your password only to those who use your account with you. You are responsible for what is done with your account, unless someone used it without your fault.
  4. Your username is shown to others (e.g. friends, people sharing with you). It must not be offensive, impersonate someone or infringe others' rights; names containing offensive words are refused. We may block a username that breaks this rule; you then choose a new one before using PaSiCC further.
  5. The beta license limits how much you can store (shown in your profile when you get close).

4. Inactive accounts

A beta account that hasn't been used for 60 days is deleted with everything only it owns. We warn you by email 14 days, 7 days and 1 day before. Logging in or using PaSiCC in an open page counts as use.

5. Your content

  1. What you create (nodes, their titles, attributes, descriptions, links) stays yours. You give us only the right to store, process and show it as far as needed to run PaSiCC for you and for those you share it with.
  2. We don't sell your content, don't show it to anyone you didn't share it with, and don't use it to train AI models. Administrators of PaSiCC can't read your nodes through PaSiCC either.
  3. You decide what you share and with whom. Those you share with see it (and, depending on the permission you give, can change, share on or delete it). You are responsible for what you share and must have the right to it.
  4. You can take your data along at any time: the export in your profile downloads everything you own as a ZIP file.

6. What is not allowed

  1. Content or use that is illegal, e.g. that infringes others' rights (copyright, personal rights), incites hatred or depicts the abuse of children.
  2. Harming PaSiCC or its users: attacks, probing for weaknesses without our consent, overloading it, automated mass requests, accessing others' accounts.
  3. Using PaSiCC to send spam or to spread malware.

If we learn of illegal content, we remove or block it. If you break these rules, we may block or delete your account, depending on how serious it is, usually after a warning; you will be told why (by email, unless the law forbids it).

7. Ending your use

  1. You can delete your account at any time in your profile. It can be restored for 30 days (you can still read the contents and manage your friends and shares, but no longer change any contents); then it is removed for good with everything only you own. Nodes shared with you stay with their owners.
  2. We may end the beta or PaSiCC as a whole with notice of at least 2 weeks by email, so you can export your data.
  3. We may delete an account at once for a serious breach of section 6.

8. Liability

PaSiCC is free during the beta. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and as far as a law (e.g. the Product Liability Act) says so. For slight negligence we are liable only if we breach an obligation essential for using PaSiCC, and then only for the damage typical and foreseeable for such a free service.

9. Changes to these terms

We may change these terms when PaSiCC or the law changes. We tell you by email at least 2 weeks before a change takes effect. The changed terms apply to you once you accept them. PaSiCC offers them to you as soon as they are published; from the day they take effect you can only go on using PaSiCC once you have accepted them. If you don't agree, you can export your data and delete your account.

10. Privacy

How we handle personal data is described in the privacy notice.

11. Law, contact

German law applies; as a consumer you keep the protection of the mandatory law of the country you live in. Questions and notices: https://bentosoftware.com/contact.html. We don't take part in dispute resolution proceedings before a consumer arbitration board.
